1. About these terms and conditions

   1. This Website and Reserve and Collect are provided by World Duty Free Group, S.A. (“we/us/our”). We are a company registered in Spain and our registered office is at Josefa Valcarcel St., 30, 28027 Madrid. When we refer to “you” and “your” we mean the user of our Website and/or Reserve and Collect.

   2. These are the Terms which apply to your use of our Website and your use of Reserve and Collect and by using our Website and/or Reserve and Collect you agree to be bound by these Terms. If you do not agree to these Terms you must not use our Website or Reserve and Collect. Please read these Terms carefully and make sure that you understand them before using the Website or Reserve and Collect.

   3. These Terms will apply to any contract between us which is formed when you access our Website and/or when you use Reserve and Collect.

   4. These Terms only apply to your viewing and use of this Website and Reserve and Collect. If you use one of the links on this Website to visit one of our partner websites, then please note that when you’re viewing these websites, any purchases made through them will be subject to separate terms and conditions.

   5. When the following words with capital letters are used in these Terms, this is what they mean:

“Privacy Policy” our privacy policy, a copy of which is available at here

“Products” any of the products featured on our Website or included in a reservation;

“Reserve and Collect” the reservation service (offered by us via our Website and as advertised in our store or on any of our websites as ‘Reserve and Collect’) which allows you to reserve Products ahead of a flight for collection at our stores in Kuwait International Airport just prior to the flight;

“Terms” these terms and conditions and the other documents referred to in it, including our Privacy Policy; and

“Website” our website at https://www.shopdutyfree.com

6. If you have any questions on these Terms, or would like to discuss a reservation made through Reserve and Collect please contact our Customer Support Team using the contact details in Clause 17 below.

7. When we use the words "writing" or "written" in these Terms, this will include e-mail correspondence unless stated otherwise.

2. Reserve and Collect

1. Reserve and Collect is available to all passengers travelling from the terminal where our stores are located. You can find details of our stores and those offering Reserve and Collect on the Website.

2. Payments for Products reserved via Reserve and Collect will be taken when you collect the Products from our store. You do not have to make any payment or provide any payment information through the Website. Please see clause 11 below for further information on payment.

3. Reservation requests must be made a minimum of 24 hours prior to departure and no more than one month prior to departure. Reservation requests made any sooner or later than this cannot be accepted by us. Note that any products that cannot be reserved due to these timing restrictions can be added to a “Wish List”, which is stored for future viewing by you.

4. After you make a reservation request via the Reserve and Collect service, you will receive an email (“Confirmation Email”) from us acknowledging that we have received your request and we will assign you a reservation request number. This reservation request number must be quoted in all subsequent correspondence with us relating to your request. Please note that the Confirmation Email is confirmation of your request only, and does not mean it has been accepted. Our acceptance of your request as an actual confirmed reservation will take place as described in clause 2.6.

5. Within seven (7) days of receiving your Confirmation Email, you should receive a separate email from us (“Reservation Email”) notifying you whether or not the Products you have requested are available and if they have been reserved for you. The Reservation Email will also include the date on which you can pay for and collect the Products, as well as the location to do so.

6. When using the Reserve and Collect service, please ensure that the details are complete and accurate before you submit the request. As part of the reservation process, you will also be asked to provide the time, date, departure airport, destination of your flight and an optional flight number. Please take particular care to ensure this information is accurate as we will use it to determine your collection date and time. If, after placing your reservation request and before receiving your Reservation Email, you realise that you have provided us with any incorrect information or you wish to amend your reservation, you can do so via the Website by logging into your account (if a password has been previously set up by you when placing the order). If you realise that you have provided us with any incorrect information or you wish to amend your reservation after you have received your Reservation Email you should cancel your reservation and place a new reservation. Alternatively, please contact our customer support team using the contact details in Clause 17 as soon as possible.

7. Note that neither the Confirmation nor the Reservation Emails are a binding offer. By making a reservation you are only reserving the Products for collection and purchase at the time of departure in compliance with customs requirements, and in store in accordance with these Terms. The completion of the contract between you and us will take place when you pay for and collect the Products in store. Title to any Products you reserve via Reserve and Collect shall pass to you when you collect and pay for the Products in store in accordance with the in store terms of sale.

8. You can cancel your reservation at any time, including after receiving the Reservation Email.

9. We reserve the right to cancel your reservation in whole or in part for any reason at any time. Where we cancel any reservation, we will try to notify you of this prior to your flight time.

3. Products

1. The images of the Products and any packaging (if applicable) on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products and/or packaging. The Products may vary slightly from those images.

2. The packaging of the Products may vary from that shown on images on our site.

3. All Products shown on our site are subject to availability and any duty free restrictions (see Clause 7). At the latest this will be discussed with you at the time of your flight, however, we will try to inform you via the Reservation Email if the Products you have reserved are not available. This earlier email notification just cannot be guaranteed due to timing and administrative limitations.

4. The range of Products offered on our Website and in our stores (including any of the products that may have been confirmed to you as reserved) is subject to change without prior notice and we reserve the right from time to time, to withdraw or cease to make available any or all of the Products from our Website.

4. Price

1. We take all reasonable care to ensure that the prices of Products are correct and up to date. However if we discover an error in the price of the Products you reserved, please see clause 4.2 for what happens in this event. Prices for the Products may change from time to time but any changes will not apply to any reservation which we have confirmed in accordance with clause 2.5.

2. Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have reserved we will try to inform you in writing of this error and we will give you the option of continuing with the reservation of the Products at the correct price or cancelling your reservation, as we will not provide the products to you at the incorrect price. We will not reserve the Products until we have your instructions. If we are unable to contact you using the contact details you provided during the reservation process, we will treat the reservation as cancelled.

3. We reserve the right to make changes to the prices of the Products from time to time but (except where the changes are due to incorrect pricing) such changes will not apply to any reservations which have been successfully placed, as confirmed by a Reservation Email.

4. The Reserve and Collect price promise guarantees you the best deal available at the time of the purchase from us. If, when you pay for and collect the Products, they are included in a promotional offer or have been discounted in the store on the date of collection, you will be charged the lower of

(a) the price of the promotional offer or discount; or

(b) the price stated in your confirmation email.

This only applies to the number of Products that have been reserved and does not apply to products which have been added to the basket within the airport store.

5.  Security

You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, email verification and password that may be given to you or selected by you for use on the Website. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding the Website that comes to your attention.

6. Changes to these terms and conditions

1. We reserve the right to amend these Terms from time to time. Any such changes will take effect when posted on our Website. Notwithstanding the above, any material changes to these Terms will be communicated to you and will need to be expressly accepted it by you.

2. Every time you make a reservation with us, the Terms in force at that time will apply to the Contract between you and us.

3. Your continued use of our Website shall signify your acceptance to be bound by the latest Terms.

7.  Availability of the Products at time of collection

1. Your reservation shall automatically be cancelled and the Products returned to the store for general sale if for any reason you do not pay for and collect the Products within 24 hours after your collection date and time stated in your Reservation Email.

2. To ensure the availability of Products in store which are included in promotional offers, there may be restrictions on the number of certain promotional Products you can reserve. Where any such restriction applies, this will typically be stated on the Website and you will not be able to reserve more than the permitted number of Products.

3. Availability of Products varies from store to store and details of Products available for reservation (where Reserve and Collect is operating) are shown on the Website.

4. When you pay for and collect the Products, we reserve the right to limit the number of a particular product we sell to you or to cancel your reservation if the products are not available at the time of collection.

5. We shall not be liable to you where circumstances arise whereby the Products you have reserved are not available or cannot be purchased on the date of your collection.

6. The Products will be your responsibility once you have collected them and you will own the Products once we have received payment in full.

8.  Restrictions

1. Some of our Products have a minimum age requirement (for example those containing alcohol), and by reserving any of these Products you confirm that you are the required age. We are not allowed by law to supply these restricted products to you if you do not satisfy the age requirements. If you are underage please do not attempt to reserve these Products. You or any person nominated by you may be required to provide proof of your age when you pay for and collect the Products.

2. All reservations are subject to any applicable customs regulations and/or duty free regulation. Adherence to any customs regulations are your responsibility. If you reserve Products which exceed the allowance under relevant customs regulations, you may be advised (but we have no obligation to advise you) to purchase only the number of Products within the limits set by the applicable customs regulations. We will not be responsible or liable if you purchase more Products than permitted by the applicable regulations.

3. A valid boarding card must be presented when collecting and paying for the Products, otherwise your reservation will be cancelled and you will be unable to purchase the Products. We reserve the right to deny purchase of the Products which are not available for purchase for the destination stated on the boarding card, but we have no obligation to do so and we will not be responsible or liable if you purchase Products that are not available for the destination stated on your boarding card.

4. If, for whatever reason, you are unable to pass through airport security into the departure area, we will be unable to fulfil your reservation and your reservation will be cancelled.

5. Please note that due to customs regulations, we are unable to deliver any uncollected Products to an alternative address outside of the relevant airport departure lounge and the Products can only be collected from the designated collection point at that airport.

9. If the products are faulty

As a consumer, you have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local consumer protection authority. Nothing in these Terms will affect these legal rights.

10.  Returns

 If you are unhappy with the Products for any reason, you may return them to us in accordance with our sixty (60) day Returns Offer.payment

1. You are not obliged to purchase any of the Products you have reserved with us using Reserve and Collect. If you change your mind when you come to pay for and collect the Products you may choose to replace the Products with any other items which are currently available in store. You will pay the price shown in-store for these items. If you no longer wish to purchase the Products, you can cancel your order via the Website prior to your departure date or by informing a member of staff at the store.

2. We accept payment in store in various currencies. If you wish to pay in a currency other than Kuwaiti Dinar (KWD), the conversion rate into the currency you wish to pay in will be determined in accordance with our in-store terms of sale on the actual date of purchase.

11. Limitations on warranties and liability

1. Subject to clause 12.4, we will use reasonable endeavours to verify the accuracy of any information on the Website but we make no representation or warranty of any kind, express or implied, statutory or otherwise regarding the contents or availability of the Website or that it will be timely or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability and of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website and we accept no liability for any kind of loss or damage from action taken in reliance on material or information contained on the Website.

2. If we fail to comply with these Terms, we are responsible for any direct loss or damage you suffer that is a foreseeable result of our breach of these Terms. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract between you and us. To the fullest extent permitted by applicable law, we will not be liable to you for any other damages of any kind, including indirect, special, consequential or incidental damages or other damages arising directly or indirectly from your use of (or your inability to use) the Website or of Reserve and Collect.

3. We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

4. We do not in any way exclude or limit our liability for:

(a) death or personal injury caused by our negligence; and

(b) fraud or fraudulent misrepresentation.

 

12. Use of our website

1. You are solely responsible for all activity while using our Website and for the security of your computing systems. You assume all liability for losses and damage incurred by us as a result of your activity on our Website, except where such losses are due to a third party who is not known to you who deliberately misuse your log-on details.

2. We reserve the right to terminate your Website account where you do not comply with these Terms or any applicable laws and regulations relating to the use of our Website. You may amend or cancel your Website registration at any time via the Website or by contacting our customer support team using the contact details in Clause 17 below.

3. You must not use the Website for any unlawful or fraudulent purposes. You must not misuse the Website by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. In particular, you must not access without authority, interfere with, damage or disrupt the Website or any part of it; any equipment or network on which the Website is stored; any software used in connection with the provision of the Website; or any equipment, software or website owned or used by a third party. You must not attack the Website via a denial‑of‑service attack.

4. Without prejudice to its other rights or remedies, we reserve the right to take legal proceedings against you for reimbursement of all costs or losses (on an indemnity basis) resulting from your breach of clause 13.3, and to disclose such information to law enforcement agencies as we reasonably believe is necessary.

13. Events Outside Our Control

1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

2. An Event Outside Our Control means for the purpose of this clause any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, supplier default or delay, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

3. If an Event Outside Our Control takes place that affects the performance of our obligations under a contract between you and us, we will notify you as soon as reasonably possible.

14.  Your restrictions on use of our Website

Subject to clause 16 below, you may not download, copy, use, make derivative use of or exploit for commercial purposes any proprietary or other information or content on our Website, including, but not limited to, any images, pricing or descriptions of the Products or any brand trademarks, trade names or logos. This includes any copies or derivative created for the benefit of a third party. Use of data mining, robots or any other kind of data gathering and/or extraction tools is strictly prohibited.

15. Intellectual property and proprietary rights

All intellectual property and other proprietary rights (i) in our Website and its content, and (ii) in any trademarks, trade names, domain names and product names used in our Website, are owned and expressly reserved by either Dufry, World Duty Free Group, its licensors or brand owners providing the Products. Any use of such rights without express written consent of the World Duty Free Group, S.A. . or the relevant brand owners is strictly prohibited.

1. If you have any questions about your reservation you can refer to your account or order details, refer to the FAQ pages, or for any concerns, please contact our Customer Support Team. 17. How we may use your personal information

1. Any personal information you supply to us when you use our Website will only be processed and used in accordance our Privacy Policy. By using our Website and/or using Reserve and Collect you consent to such processing and terms.

18. Feedback

1. We welcome your comments and feedback regarding our Website, our services and as Product reviews. By submitting information in this way, you are expressly granting us an irrevocable and unrestricted licence to use, modify, reproduce, display and distribute such information for any purpose whatsoever at our sole discretion. You also waive any and all moral rights in such information. Unless required by law, we will not obtain your prior written consent to attribute such information to you..

19. Other important terms

1. We may at our sole discretion transfer our rights and obligations under these Terms to another organisation.

2. Any contract concluded pursuant to these Terms is made between you and us. No other person shall have any rights to enforce any of its terms.

3. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

4. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

5. The Terms, as amended from time to time, constitute the entire agreement between you and us regarding your rights and obligations in respect to your access to our Website and use of Reserve and Collect services we may provide you.

6. These Terms are governed by the provisions of the law of Kuwait. Where the user, who is an individual (consumer), is located in Kuwait, the user shall submit a dispute and/or disagreement related to the Program or these Terms and Conditions, which cannot be resolved through mutual negotiations between the user and World Duty Free Group, S.A, for resolution to the exclusive jurisdiction of the Courts of Kuwait.

الشروط والأحكام

 

1. نبذة عن هذه الشروط والأحكام

   1. موقع الويب هذا وخدمة Reserve and Collect يتم توفيرهما بواسطة شركة World Duty Free Group, S.A. (“نحن/ضمير المفعول “نا”/ضمير الملكية”نا”). نحن شركة مسجلة في أسبانيا ويقع مكتبنا المسجل في شارع جوسيفا فالكارسل، 30, 28027 مدريد. عند الإشارة باستخدام ضمير المُخاطب “أنت” و”كاف المخاطب”، فإننا نعني مستخدم موقع الويب و/أو خدمة Reserve and Collect.

   2. هذه هي الشروط التي تسري على استخدامك لموقع الويب الخاص بنا وخدمة Reserve and Collect ويُعد استخدامك لموقعنا و/أو خدمة Reserve and Collect موافقةً منك على الالتزام بهذه الشروط. إن لم تكن توافق على هذه الشروط، فيجب ألا تستخدم موقع الويب الخاص بنا أو خدمة Reserve and Collect. يُرجى قراءة هذه الشروط بعناية والتأكد من فهمها قبل استخدام موقع الويب أو خدمة Reserve and Collect.

   4. لا تسري هذه الشروط إلا على دخولك إلى هذا الموقع وخدمة Reserve and Collect واستخدامك لهما. فإذا استخدمت أحد الروابط الموجودة على موقع الويب هذا لزيارة أحد مواقع الويب التابعة لشركائنا، يُرجى حينئذٍ ملاحظة أنه بعرضك لتلك المواقع، ستخضع أي عملية شراء تتم من خلالها لشروط وأحكام منفصلة.

   5. تحمل الكلمات التالية المكتوبة بخط عريض المستخدمة في هذه الشروط المعاني التالية:

“Reserve and Collect” خدمة الحجز (التي نعرضها على موقع الويب الخاص بنا والتي يتم الإعلان عنها في متاجرنا أو أي من مواقع الويب الخاصة بنا تحت مُسمّى “Reserve and Collect”) والتي تتيح حجز منتجات قبل رحلة طيران لاستلامها في متاجرنا الكائنة في مطار الكويت الدولي قبيل الرحلة;

“الشروط” هذه الشروط والأحكام وأي وثائق أخرى مشار إليها فيها بما يشمل سياسة الخصوصية الخاصة بنا؛ و

6. إذا كانت لديك أي استفسارات بشأن هذه الشروط أو كنت ترغب في مناقشة أي حجز تم من خلال Reserve and Collect، يُرجى الاتصال بفريق دعم العملاء التابع لنا باستخدام تفاصيل الاتصال الواردة في البند 17 أدناه.

7. عند استخدام الكلمات “كتابيًا” أو “مكتوب” في هذه الشروط، فإن هذا يشمل المراسلات عبر البريد الإلكتروني ما لم يُذكر خلاف ذلك.

2. خدمة Reserve and Collect

   1. تُتاح خدمة Reserve and Collect لجميع الركاب المسافرين من صالات السفر التي توجد بها متاجر لنا. ويمكنك الاطلاع على التفاصيل المتعلقة بمتاجرنا وتلك التي تقدم خدمة Reserve and Collect على موقع الويب.

   2. يتم سداد المدفوعات الخاصة بالمنتجات التي يتم حجزها عبر Reserve and Collect عند استلامك للمنتجات من متجرنا، ولا يجب عليك سداد أي دفعات أو تقديم أي معلومات متعلقة بالدفع عبر موقع الويب. يُرجى الاطلاع على البند 11 أدناه لمعرفة المزيد من المعلومات المتعلقة بالدفع.

   3. يجب تقديم طلبات الحجز قبل 24 ساعة على الأقل من المغادرة وبما لا يتجاوز شهرًا واحدًا قبل المغادرة. لا يمكننا قبول طلبات الحجز التي تتم في أي وقت أقرب أو أبعد من ذلك. تُرجى ملاحظة أن أي منتجات لا يمكن حجزها بسبب تلك القيود الزمنية يمكن إضافتها إلى قائمة الرغبات “Wish List” والتي يتم تخزينها من أجل عرضها لك في المستقبل.

   4. بعد تقديمك طلب حجز عبر Reserve and Collect، فإنك تتلقى رسالة بريد إلكتروني (“رسالة التأكيد”) منّا للإقرار باستلامنا طلبك وسوف نخصص لك رقم طلب حجز. يجب ذكره في جميع المراسلات اللاحقة التي تُجرى بيننا فيما يتعلق بطلبك. يُرجى ملاحظة أن رسالة التأكيد ليست إلا تأكيدًا باستلام طلبك ولا تعني قبوله. إذ يتم قبول طلبك كحجز مؤكد بالفعل على النحو المبين في البند 2.6.

   5. تتلقى منا رسالة بريد إلكتروني منفصلة (“رسالة الحجز”)، في غضون سبعة (7) أيام من تلقي رسالة التأكيد نبلغك فيها بما إذا كانت المنتجات التي طلبتها متاحة وما إذا قد تم حجزها لك أم لا. وتتضمن رسالة الحجز أيضًا التاريخ والمكان الذي يمكنك فيه سداد ثمن المنتجات واستلامها.

   6. عند استخدام خدمة Reserve and Collect، يُرجى التحقق من اكتمال التفاصيل ودقتها قبل إرسال الطلب. وكجزء من عملية الحجز، سوف يُطلب منك أيضًا ذكر وقت الرحلة وتاريخها ومطار الإقلاع ومطار الوصول والرقم الاختياري للرحلة. يُرجى التأكد من دقة هذه المعلومات لكونها تُستخدم في تحديد تاريخ ووقت استلامك للمنتج. إذا أدركت، بعد تقديم طلب الحجز وقبل استلامك رسالة الحجز، أنك قد قدمت إلينا أي معلومات غير دقيقة أو إذا رغبت في تعديل حجزك، يمكنك القيام بذلك عبر موقع الويب عن طريق تسجيل الدخول إلى حسابك (إذا كنت قد عينت سابقًا كلمة مرور عند تقديم الطلب). وإذا أدركت أنك قد قدمت إلينا معلومات غير دقيقة أو إذا كنت ترغب في تعديل حجزك بعد استلام رسالة الحجز، فيجب عليك إلغاء حجزك وإجراء حجز جديد. أو يمكن، بدلًا عن ذلك، الاتصال بفريق دعم العملاء لدينا باستخدام تفاصيل الاتصال الواردة في البند 17 في أقرب وقت ممكن.

   1. تتوفر صور المنتجات وأي تغليف (إن وجد) على موقع الويب الخاص بنا لأغراض التوضيح فقط. على الرغم من أننا بذلنا كل جهد لعرض الألوان بدقة، إلا أنه لا يمكننا أن نضمن أن عرض الكمبيوتر للألوان يعكس بدقة لون المنتجات و/أو التغليف. فقد تختلف المنتجات اختلافًا طفيفًا عن تلك الصور.

4. السعر

   1. نتوخى العناية المعقولة لضمان أن تكون أسعار المنتجات صحيحة ومحدثة. ومع ذلك، في حالة اكتشاف أي خطأ في سعر المنتجات التي حجزتها، ففي تلك الحالة ينطبق البند 4.2. ويمكن أن تتغير أسعار المنتجات من وقتٍ لآخر ولكن لا تسري أي تغييرات على أي حجز قد أكدنا عليه وفقًا للبند 2.5.

   2. يحتوي موقعنا على عددٍ كبيرٍ من المنتجات، ومن المحتمل دائمًا أن يتم تسعير بعض المنتجات على موقعنا تسعيراً غير صحيحًا على الرغم من جهودنا المعقولة لعدم حدوث ذلك. فإذا ما اكتشفنا أي خطأ في سعر المنتجات التي حجزتها، فسنحاول إبلاغك بهذا الخطأ كتابيًا ونقدم لك خيار مواصلة حجز المنتجات بالسعر الصحيح أو إلغاء حجزك، لأننا لن نقدم لك المنتجات بالسعر غير الصحيح. ولن نحجز المنتجات إلى أن نتلقى تعليمات منك بذلك. وإذا لم نتمكن من الاتصال بك باستخدام تفاصيل الاتصال التي قدمتها أثناء عملية الحجز، فإننا نتعامل مع الحجز على أنه مُلغى.

   3. نحتفظ بالحق في إجراء تغييرات من وقتٍ لآخر على أسعار المنتجات ولكن (ما لم تكن التغييرات بسبب تسعير غير صحيح) لا تسري تلك التغييرات على أي عمليات حجز تمت بنجاح وتم التأكيد عليها عن طريق رسالة حجز.

   4. يضمن لك وعد السعر عبر خدمة Reserve and Collect أفضل صفقة متاحة في وقت الشراء منّا. وإذا كانت المنتجات مشمولة، عند سدادك ثمن المنتجات واستلامها، في عرض ترويجي أو يوجد خصم عليها في المتجر في تاريخ استلامك لها، فستتم محاسبتك وفق

      1. السعر الأقل من بين العرض الترويجي أو الخصم؛ أو

      2. السعر المذكور في رسالة التأكيد الخاصة بك.

ولا يسري هذا إلا على عدد المنتجات التي تم حجزها ولا يشمل المنتجات التي تمت إضافتها إلى السلة داخل متجر المطار.

5. الأمن

تتحمل وحدك المسؤولية من جميع الجوانب عن كافة استخدامات وحماية سرية اسم المستخدم ومصادقة البريد الإلكتروني وكلمة المرور التي يتم تزويدك بها أو تقوم أنت بإنشائها بغرض استخدام موقع الويب. ولا يجوز لك مشاركة هذه البيانات مع أو نقلها إلى أي أطراف ثالثة. ويجب عليك إبلاغنا على الفور بأي استخدام غير مصرح به لها أو أي انتهاك أمني آخر تعلم به فيما يتعلق بموقع الويب.

6. التغييرات على هذه الشروط والأحكام

   1. نحتفظ بالحق في تعديل هذه الشروط من وقتٍ لآخر. وتسري أي من هذه التغييرات عند نشرها على موقع الويب الخاص بنا. وبصرف النظر عما سبق، سيتم إبلاغك بأي تغييرات جوهرية في هذه الشروط وسيُطلب منك قبولها صراحةً.

   2. وفي كل مرة تقوم فيها بالحجز لدينا، تسري الشروط المعمول بها في ذلك الوقت على العقد المبرم بيننا.

   3. يُعد استمرارك في استخدام موقع الويب الخاص بنا دليلًا على قبولك الالتزام بأحدث الشروط.

7. توافر المنتجات في وقت الاستلام

   1. يتم إلغاء حجزك تلقائيًا وإعادة المنتجات إلى المتجر لبيعها إلى الجمهور إذا لم تدفع ثمن المنتجات وتستلمها لأي سببٍ من الأسباب في غضون 24 ساعة بعد التاريخ والوقت المحددين لاستلامك المنتجات في رسالة الحجز المرسلة عبر البريد الإلكتروني.

   2. لضمان توافر المنتجات المشمولة في العروض الترويجية في المتجر، يمكن أن تُطبق قيود بشأن عدد المنتجات الترويجية التي يمكنك حجزها. وعند تطبيق أي من تلك القيود، يتم في العادة نشر ذلك على الموقع ولن تتمكن من حجز ما يزيد عن العدد المسموح به من المنتجات.

   3. يختلف توافر المنتجات من متجر لآخر وتنشر التفاصيل المتعلقة بالمنتجات المتوافرة للحجز على موقع الويب (في الأماكن التي تعمل بها خدمة Reserve and Collect).

   4. عند سدادك ثمن المنتجات واستلامها، نحتفظ بالحق في تقييد عدد منتجات معينة مما نبيعه لك أو إلغاء حجزك إذا لم تكن المنتجات متوافرة وقت الاستلام.

   5. ولا نتحمل أي مسؤولية تجاهك إذا نشأت أي ظروف أدت إلى عدم توافر المنتجات التي حجزتها أو عدم إمكانية شرائها في التاريخ المحدد لاستلامك.

   6. تصبح المنتجات مسؤوليتك بمجرد استلامك لها وملكية خاصة بك بمجرد حصولنا على المدفوعات بالكامل.

8. القيود

   1. ترتبط بعض منتجاتنا بحد أدنى لعمر الشخص الذي تباع له (مثل تلك التي تحتوي على الكحول)، وبحجزك لتلك المنتجات، فإنك تؤكد على بلوغك العمر المطلوب. يُحظر علينا قانونًا توفير تلك المنتجات المقيدة لك إذا لم تستوف المتطلبات العُمرية. فإذا كنت قاصراً، يُرجى عدم محاولة حجز تلك المنتجات. قد يُطلب منك أو ممن تعينه تقديم إثبات على عُمرك عند سدادك ثمن المنتجات واستلامك لها.

   2. تخضع جميع عمليات الحجز لأي لوائح جمركية و/أو إعفاءات جمركية معمول بها. وتتحمل أنت مسؤولية الالتزام بأي لوائح جمركية؛ فإذا حجزت منتجات تتجاوز الحد المسموح به بموجب اللوائح الجمركية ذات الصلة، فقد نشير عليك (لكننا لسنا ملزمين بذلك) بعدم شراء سوى عدد المنتجات الذي يتفق مع الحد المنصوص عليه في اللوائح الجمركية المعمول بها، ولا نتحمل أي مسؤولية أو التزام عند شرائك عددًا من المنتجات أكبر من المسموح به بموجب اللوائح المعمول بها.

   3. يجب تقديم بطاقة صعود سارية عند استلام المنتجات ودفع ثمنها، وإلا سيتم إلغاء حجزك ولن تتمكن من شراء المنتجات. ونحتفظ بالحق في رفض شراء المنتجات غير المتاحة لجهة الوصول المذكورة في بطاقة الصعود غير أننا لا نتحمل أي التزام بالقيام بذلك ولا أي مسؤولية أو التزام عند شرائك المنتجات غير المتاحة لجهة الوصول المذكورة في بطاقة الصعود الخاصة بك.

   4. إذا لم تتمكن، لأي سببٍ من الأسباب، من اجتياز أمن المطار إلى منطقة الإقلاع، لن نتمكن من تنفيذ حجزك وسوف يتم إلغاؤه.

   5. يُرجى ملاحظة أنه بموجب اللوائح الجمركية، لن يمكننا تسليم أي منتجات لم يتم استلامها إلى عنوان بديل خارج صالة المغادرة في المطار ذي الصلة ولا يمكن استلام المنتجات إلا من نقطة الاستلام المعينة في هذا المطار.

9. إذا كانت المنتجات معيبة

بصفتك مستهلكًا، تتمتع بالحقوق القانونية فيما يتعلق بالمنتجات المعيبة أو غير المطابقة للوصف. ويمكن الحصول على مشورة بشأن حقوقك القانونية من هيئة حماية المستهلك المحلية الخاصة بك، ولا يؤثر أي شيء وارد في هذه الشروط على حقوقك القانونية هذه.

10. المرتجعات

إذا لم تنل المنتجات رضاك لأي سبب من الأسباب، يجوز لك إرجاعها إلينا وفقًا لعرض الإرجاع الذي مدته (60) يومًا لدينا.

1. لست ملزمًا بشراء أي منتجات حجزتها لدينا باستخدام خدمة Reserve and Collect، فإذا غيرت رأيك عند مجيئك لسداد ثمن المنتجات واستلامها، يجوز لك اختيار استبدال هذه المنتجات بأي منتجات أخرى متوافرة في المتجر في ذلك الوقت. وتدفع السعر المحدد داخل المتجر فيما يتعلق بهذه المنتجات. وإذا لم تعد ترغب في شراء المنتجات، يمكن إلغاء طلبك عبر موقع الويب قبل تاريخ مغادرتك أو عن طريق إبلاغ أحد موظفي المتجر.

2. نحن نقبل الدفع في المتجر بعملات مختلفة. فإذا كنت ترغب في السداد بعملة أخرى خلاف الدينار الكويتي، يتم تحديد سعر التحويل إلى العملة التي ترغب في السداد بها وفقُا لشروط البيع داخل المتجر في التاريخ الفعلي لعملية الشراء.

11. القيود المفروضة على الضمانات والمسؤولية القانونية

    1. بموجب البند 12.4، نبذل الجهود المعقولة للتحقق من دقة أي معلومات على موقع الويب ولكننا لا نقدم أي إقرار أو ضمان من أي نوع، صراحًة أو ضمنًا، سواءً كان قانونيًا أو خلافه فيما يتعلق بمحتويات أو إتاحة موقع الويب أو أنه سيكون في الوقت المناسب أو خاليًا من الأخطاء أو أن يتم تصحيح العيوب أو أن يكون موقع الويب أو الخادم الذي يجعله متاحًا خاليًا من الفيروسات أو الأخطاء أو يمثل الأداء الوظيفي والدقة والموثوقية الكاملة لموقع الويب. ولن نتحمل أية مسؤولية أو التزام تجاهك فيما يتعلق بأي فقد للمحتوى أو المواد التي يتم تحميلها أو نقلها من خلال موقع الويب ولا نوافق على تحمل أي التزام عن أي نوع من الخسائر أو الأضرار الناتجة عن أي تدبير يتم اتخاذه اعتماداً على المواد أو المعلومات الموجودة على موقع الويب.

    2. وفي حالة عدم التزامنا بهذه الشروط، فإننا نتحمل المسؤولية عن أي خسارة أو ضرر مباشر تعاني منه مما يكون نتيجة متوقعة لخرقنا لهذه الشروط. وتكون الخسارة أو الضرر متوقعًا إذا كان تم اعتباره نتيجة واضحة للخرق المنسوب إلينا أو كان أمرًا متوقعًا من كلينا وقت إبرام العقد بيننا. وإلى أقصى حد يسمح به القانون المعمول به، لن نكون مسؤولين تجاهك عن أي أضرار أخرى أيًا كان نوعها، بما في ذلك الأضرار غير المباشرة أو الخاصة أو التبعية أو العرضية أو أي أضرار أخرى تنشأ بطريقة مباشرة أو غير مباشرة عن استخدامك (أو عدم قدرتك على استخدام) موقع الويب أو خدمة Reserve and Collect.

    3. نحن نورِّد المنتجات لغرض الاستخدام المنزلي والخاص فقط. وأنت توافق على عدم استخدام المنتج لأي غرض تجاري أو متعلق بالأعمال أو بإعادة البيع ولا نتحمل أي مسؤولية تجاهك عن أي فوات للربح أو خسارة في الأعمال أو تعطلها أو عن فقدان فرص العمل.

    4. ولا نستبعد أو نقيد مسؤولياتنا بأي حال من الأحوال بشأن ما يلي:

       1. الوفاة أو الإصابة الشخصية الناتجة عن إهمالنا؛ و

       2. الاحتيال أو البيانات الكاذبة بغرض الاحتيال.

12. استخدام موقع الويب الخاص بنا

    1. أنت تتحمل المسؤولية بمفردك عن جميع الأنشطة التي تقوم بها أثناء استخدامك لموقع الويب وعن أمن أنظمة الكمبيوتر خاصتك. كما أنك تتحمل جميع المسؤوليات الناجمة عن الخسائر والأضرار التي نتكبدها نتيجة نشاطك على موقع الويب الخاص بنا، ما لم تكن هذه الخسائر نتيجة قيام طرف ثالث لا تعرفه بتعمد إساءة استخدام تفاصيل تسجيل الدخول الخاصة بك.

    2. نحن نحتفظ بحق إنهاء حسابك على موقع الويب في حالة عدم امتثالك لهذه الشروط أو لأي قوانين أو لوائح معمول بها تتعلق باستخدام موقع الويب الخاص بنا. ويجوز لك تعديل تسجيلك على موقع الويب أو إلغائه في أي وقت من خلال موقع الويب أو من خلال الاتصال بفريق دعم العملاء لدينا باستخدام تفاصيل الاتصال الواردة في البند 17 أدناه.

    3.  يُحظر استخدام موقع الويب لأي غرض من الأغراض غير القانونية أو الاحتيالية. كما يُحظر إساءة استخدام موقع الويب عن طريق إدخال الفيروسات أو فيروسات حصان طروادة أو الفيروسات المتنقلة أو القنابل المنطقية أو أي مواد أخرى خبيثة أو ضارة تقنيًا. وعلى وجه الخصوص، يُحظر الدخول دون سلطة إلى أو التداخل مع أو إتلاف أو تعطيل موقع الويب أو أي جزء منه أو أي جهاز أو شبكة يتم تخزين موقع الويب عليها أو أي برنامج يُستخدم فيما يتعلق بتوفير موقع الويب أو أي جهاز أو برنامج أو موقع ويب يملكه أو يستخدمه طرف ثالث. يُحظر الهجوم على موقع الويب عبر هجمة حجب الخدمة.

    4. دون المساس بحقوقنا أو سبل الانتصاف الأخرى المتاحة لنا، نحتفظ بحق اتخاذ الإجراءات القانونية ضدك للحصول على تعويض عن كافة التكاليف والخسائر (على أساس التعويض) الناتجة عن خرقك للبند 13.3 وبحق الإفصاح عن تلك المعلومات إلى وكالات إنفاذ القانون على النحو الذي نراه ضروريًا بشكلٍ معقول.

13. الأحداث الخارجة عن سيطرتنا

    1. لن نكون مسؤولين عن أي إخفاق في أداء أي من التزاماتنا بموجب هذه الشروط أو التأخر في أدائها إذا كان ذلك نتيجة وقوع حدث خارج عن سيطرتنا.

    2. حدث خارج عن سيطرتنا يعني ، لأغراض هذا البند، أي فعل أو حدث خارج نطاق سيطرتنا المعقولة، بما يتضمن، على سبيل المثال لا الحصر: الإضرابات أو إغلاق أماكن العمل أو أي إجراء صناعي آخر بواسطة أطراف ثالثة أو تقصير المورد أو تأخيره أو القلاقل المدنية أو أعمال الشغب أو العدوان أو الهجوم الإرهابي أو التهديد بالهجوم الإرهابي أو الحرب (المعلنة أو غير المعلنة) أو التهديد بالحرب أو الإعداد لها أو الحريق أو الانفجار أو العاصفة أو الفيضان أو الزلزال أو الانخساف أو الوباء أو أي كارثة طبيعية أخرى أو تعطل شبكات الاتصالات العامة أو الخاصة.

    3. إذا وقع أي حدث خارج عن سيطرتنا يؤثر على أداء التزاماتنا بموجب عقد مُبرم بيننا، فسنخطرك في أقرب وقت ممكن.

14. القيود المفروضة عليك بشأن استخدام موقع الويب الخاص بنا

بموجب البند 16 أدناه, لا يجوز لك القيام بتنزيل أي ملكية أو معلومات أو غير ذلك مما هو موجود على موقع الويب الخاص بنا، بما يشمل، على سبيل المثال لا الحصر: أي صور أو أسعار أو مواصفات المنتجات أو أي علامات تجارية أو أسماء تجارية أو شعارات، ولا القيام بنسخها أو اشتقاقها أو استغلالها لأغراض تجارية. ويشمل ذلك أي نُسخ أو مشتقات يتم إصدارها لمصلحة طرف ثالث. يُحظر تمامًا استخدام أي أدوات لجمع البيانات أو روبوتات أو أي أداة أخرى من أدوات جمع البيانات أو استخراجها.

15. الملكية الفكرية وحقوق الملكية

تُعد جميع حقوق الملكية الفكرية وحقوق الملكية الأخرى (1) في موقع الويب الخاص بنا أو في المحتوى الخاص به، و(2) في أي علامات تجارية وأسماء تجارية وأسماء مجالات وأسماء منتجات مستخدمة في موقع الويب الخاص بنا مملوكة ومحفوظة صراحةً لشركة Dufry أو World Duty Free Group أو مانحي التراخيص أو مالكي العلامات التجارية الذين يقدمون المنتجات. ويُحظر تمامًا استخدام هذه الحقوق بدون موافقة كتابية صريحة من شركة World Duty Free Group, S.A. أو من مالكي العلامات التجارية المعنيين.

16. كيف تتصل بنا

    1. إذا كان لديك أي أسئلة بشأن حجزك، يمكنك الرجوع إلى حسابك أو تفاصيل الأمر أو صفحات الأسئلة الشائعة، أو يمكن الاتصال على فريق دعم العملاء للإبلاغ عن أي مخاوف لديك. يمكنك الاتصال على فريق دعم العملاء لدينا عن طريق الهاتف 965 2431 5173+, أو عنوان البريد إلكتروني customerservice.kw@dufry.com أو عن طريق إرسال خطاب إلى شركة World Duty Free Group, S.A، إدارة خدمة العملاء في مطار الكويت الدولي، منطقة المغادرة، طابق الميزانين، الغرفة 848.

17. كيف نستخدم معلوماتك الشخصية

    1. لن يتم معالجة واستخدام أي معلومات شخصية تقدمها لنا عند استخدامك لموقع الويب الخاص بنا إلا وفقًا لسياسة الخصوصية الخاصة بنا. ويعتبر استخدامك لموقع الويب الخاص بنا و/أو خدمة Reserve and Collect موافقةً منك على عملية المعالجة والشروط.

18. التعقيبات

    1. نرحب بتعليقاتك وتعقيباتك على موقع الويب الخاص بنا وخدماتنا وتقييم منتجاتنا. وعند تقديمك معلومات من هذا القبيل، فإنك تمنحنا صراحةً رخصة غير قابلة للإلغاء وغير مقيدة لاستخدام هذه المعلومات وتعديلها ونسخها وعرضها وتوزيعها ولأي غرضٍ كان وفقا لتقديرنا المطلق. كما أنك تتنازل عن أي وجميع الحقوق الأخلاقية في هذه المعلومات. وما لم يقتض القانون خلاف ذلك، لن نحصل على موافقة خطية مسبقة منك لنسب هذه المعلومات إليك.

19. شروط مهمة أخرى

    1. قد نقوم، وفقًا لتقديرنا المطلق، بنقل ملكية حقوقنا والتزاماتنا بموجب هذه الشروط إلى مؤسسة أخرى.

    2. وأي عقد يتم إبرامه بموجب هذه الشروط هو عقد بيننا وبينك. ولن يكون لأي شخص آخر أي حق في إنفاذ أي من شروطه.

    3. وتسري كل فقرة من فقرات هذه الشروط بشكلٍ مستقل. في حال قررت أي محكمة أو سلطة مختصة بأن أيًا من هذه الفقرات غير قانوني، تظل باقي الفقرات سارية ونافذة بشكلٍ كامل.

    4. وفي حالة عدم إصرارنا على قيامك بأداء التزاماتك بموجب هذه الشروط أو عدم إنفاذنا لحقوقنا ضدك أو إذا تأخرنا في القيام بذلك، فلا يعني هذا تنازلنا عن حقوقنا ضدك أو أنه لا يتعين عليك التقيد بهذه الالتزامات. في حالة تنازلنا عن أي تقصير من جانبك، فسنعمد إلى تسجيل ذلك كتابيًا ولن يعني ذلك بأننا سنتنازل تلقائيًا عن أي تقصير لاحق من جانبك.

    5. وتشكل الشروط، حسبما يتم تعديلها من حين لآخر، الاتفاقية الكاملة فيما بيننا بشأن حقوقك والتزاماتك فيما يتعلق بدخولك إلى موقع الويب الخاص بنا واستخدام خدمة Reserve and Collect التي قد نقدمها لك.

    6. تخضع هذه الشروط لأحكام القانون الكويتي. في حالة كون المستخدم، وهو فرد (مستهلك)، مقيمًا في دولة الكويت، فيجب عليه إحالة أي نزاع و/أو خلاف يتعلق بالبرنامج أو هذه الشروط والأحكام، والذي لا يمكن حله من خلال المفاوضات الودية بين المستخدم وWorld Duty Free Group, S.A، إلى التسوية أمام الاختصاص القضائي الحصري لمحاكم الكويت.
